Abstract
The election has been one of the main features of a democratic country. Recent developments like the introduction of Electoral Bonds have shed serious questions on the electoral process of representatives in our democracy. The prevailing practices of the political parties for the sake of acquiring political power have defeated the very purpose of election laws. This paper examines eloquently, major laws regulating political funding for political parties. In addition to this, it attempts to draw a comparison between political funding laws in USA and India. The outcome of the Analytical & Doctrinal analysis is that the resilient nature of the major laws governing Political Funding is not efficient enough to control and regulate free and fair elections. It examines the validation of the scheme with respect to the ‘Basic Structure’ doctrine of the Constitution and recommends developing political ethics through various normative statutes restricting the influence of money. Therefore, the author here emphasizes reconsideration of the recommendation made by various committees. Additionally, it also puts forward the conclusion drawn through comparison with other democracies, to be applied in India. Finally, it suggests the anatomization of an Independent regulatory authority to ensure a transparent election process and hence healthy and true democracy.
