Abstract
This Book Chapter delves into the intricate interplay between constitutional authorities, democratic principles, and the mechanisms governing electoral and economic domains. Focusing on the role of constitutional bodies in safeguarding democratic integrity, it meticulously analyses the multifaceted powers of the Election Commission in upholding electoral fairness and the regulatory challenges posed by the distribution of freebies during election campaigns. The Book Chapter also investigates the boundaries of Judicial Review doctrine in the context of economic policy formulation, particularly concerning election manifestos and freebie politics. The Author thoroughly evaluates legal provisions, judicial precedents, and constitutional framers’ intent. It highlights the pivotal role of constitutional authorities in maintaining the essence of democracy by ensuring fair elections and fostering a level playing field. Innovatively, the author proposes pragmatic solutions to address challenges posed by unchecked distribution of freebies and unbridled populist economic policies. These solutions blend legal reforms with institutional safeguards, promoting responsible electioneering and economic decision-making. Moreover, the Book Chapter argues for a nuanced approach to judicial review of economic policies, emphasizing the judiciary’s role as a counterbalance while respecting the executive’s domain. By addressing critical issues of electoral fairness, freebie regulation, and economic policy oversight, this Book Chapter contributes ingenuously to the discourse on strengthening democratic governance and constitutional accountability.
